The Finance Ministry once again reiterated that it will not re-open cases where assessment has been completed before April 1, 2012. However, Vodafone continues to be on the hook, since the Finance Ministry has said the Vodafone matter does not involve assessment of income, but is about alleged default in fulfilling the withholding tax obligation. Govt replies to Vodafone notice, says 'no cause of action'

The government has replied to the arbitration notice of British telecom major Vodafone in the tax dispute case saying that the notice was premature and there was no cause of action. "We have replied to Vodafone that there is no cause of action because no law has been amended ...," a top Finance Ministry official said. The Dutch subsidiary of Vodafone had last month served a notice on the Indian government invoking BIPA between India and the Netherlands and threatened international arbitration in the tax case. The issue pertains to the amendment in Income Tax Act with retrospective effect, which would bring Vodafone-type deals under the tax net. The amendments to the I-T Act, which were approved by Parliament, would neutralise the victory of Vodafone in the tax case and the company, according to estimates, would be liable to pay about Rs 20,300 crore as tax, penalty and interest. Government plans to ask mobile phone companies to pay market rate for 2G waves

The government plans to ask all mobile phone companies to pay auction-discovered price for the 2G spectrum they hold for the remaining period of their licences, as it seeks to create a level playing field, said a top telecom ministry official. The move will send shockwaves among existing operators as back-of-the-envelope calculations suggest these companies will have to pay several thousands of crores if the Cabinet approves the policy change proposed by the Communications Ministry. Bharti Group JV acquires 49% stake in start-up Y2CF

A Bharti Group joint venture company, set up last year to invest in social media and gaming and partly managed by promoter Sunil Mittal's son Kavin, has made its first acquisition in the e-commerce space. Bharti SoftBank Holdings (BSB), the JV between the Indian mobile phone firm and Japanese communications major SoftBank Corp, is picking up a 49% stake in Gurgaon-based value-added services startup Y2CF, two executives linked to the development said. BSB has the option to acquire the remaining stake at a future date, these executives added. Y2CF has developed a location-based platform called 'Hoppr' that has been simultaneously launched by six mobile operators - Airtel, Aircel, Idea, Reliance, Tata Docomo, and Vodafone. MTNL cuts 3G tariff, signals new price war

Mahanagar Telephone Nigam Ltd., the state-run company that provides telecommunication services in India's two largest cities, has cut the tariff for Internet usage on its third-generation network by about 70%, signalling a new wave of price war in the sector. Mahanagar Telephone's price cut comes after market leader Bharti Airtel Ltd., second-ranked Reliance Communications Ltd. and Idea Cellular Ltd., slashed their rates by 62%-70% over the past few weeks to entice more people to use 3G services that allow fast data transfer. Reliance Comm names new CEO for mobile unit
